Governance of Generative Artificial Intelligence in Digital Marketing: A Comparative Analysis of Global Systems from a Consumer Protection Perspective (Arabic)

The study aims to analyze the legal and ethical challenges of the governance of generative artificial intelligence in digital marketing, which has turned into an arena of geopolitical struggle in which major powers compete to impose their standards as instruments of cross-border influence, through a focus on data privacy, deepfakes as a tool for destabilization, and civil liability. The study relies on a comparative qualitative analytical approach to regulatory frameworks, regarding them as divergent power projects between the European Union, the United States, and China, and their repercussions on Arab models, such as (Saudi Arabia, the UAE, and Egypt). The results showed that the operational differences between the global models are not merely a matter of legal interpretation, but rather a reflection of political doctrines: while the European Union adopts the normative-power model, and the United States banks on market sovereignty, China seeks to entrench a model of international control. In the Arab context, the study revealed an accelerating maturity, particularly with the issuance of the executive regulations of the Data Protection Law in Egypt in 2025, which narrows the regional readiness gap. The study recommends the formulation of an Arab digital sovereignty charter that protects the consumer from systematic algorithmic manipulation, and transforms governance from a mere compliance cost into a security and economic necessity, in order to ensure sustainability in a market that has become an arena for geopolitical influence.

حوكمة الذكاء الاصطناعي التوليدي في التسويق الرقمي: تحليل مقارن للنظم العالمية من منظور حماية المستهلك

تستهدف الدراسة تحليل التحديات القانونية والأخلاقية لحوكمة الذكاء الاصطناعي التوليدي في التسويق الرقمي الذي تحوَّل إلى ميدان صراع جيوسياسي تتنافس فيه القوى الكبرى لفرض معاييرها كأدوات نفوذ عابرة للحدود؛ وذلك من خلال التركيز على خصوصية البيانات، والتزييف العميق كأداة لزعزعة الاستقرار والمسئولية المدنية، وتعتمد الدراسة على منهج تحليل كيفي مقارن للأطر التنظيمية بوصفها مشروعات قوة متباينة بين الاتحاد الأوروبي والولايات المتحدة والصين، وانعكاساتها على النماذج العربية؛ مثل: (السعودية، والإمارات، ومصر)، وأظهرت النتائج أن الفوارق التشغيلية بين النماذج العالمية ليست محض اجتهاد قانوني، بل انعكاس لعقائد سياسية؛ فبينما يتبنَّى الاتحاد الأوروبي نموذج القوة المعيارية، وتراهن الولايات المتحدة على سيادة السوق، تسعى الصين لترسيخ نموذج السيطرة الدولية، وفي السياق العربي، كشفت الدراسة عن نضج متسارع، لا سيما مع صدور اللائحة التنفيذية لقانون حماية البيانات في مصر عام 2025؛ ممَّا يقلص فجوة الجاهزية الإقليمية، وتوصي الدراسة بصياغة ميثاق سيادة رقمي عربي يحمي المستهلك من التلاعب الخوارزمي الممنهج، ويحوِّل الحوكمة من مجرد تكلفة امتثال إلى ضرورة أمنية واقتصادية؛ لضمان الاستدامة في سوق أصبح ساحة للتأثير الجيوسياسي.
